1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Patchwork Wilds ("Company," "we," "us," or "our"), concerning your access to and use of the www.patchworkwilds.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms and Conditions.

2. Intellectual Property Rights

Unless otherwise indicated, the Site and all digital products sold on the Site, including but not limited to digital quilt patterns, templates, tutorials, text, photographs, graphics, and logos (collectively, the "Content") are our proprietary property and are protected by copyright and trademark laws.

Digital Quilt Pattern License and Usage:

When you purchase a digital quilt pattern from Patchwork Wilds, you are purchasing a limited, non-exclusive, non-transferable license to use the pattern for personal, non-commercial purposes.
 

• You May: Print a copy of the pattern for your own personal use. Sell a limited number of finished quilts made from our patterns on a small-scale, independent basis (e.g., at local craft fairs or your own small online shop), provided you clearly credit Nika Gordham-Harrison and Patchwork Wilds as the pattern designer.

• You May Not: Reproduce, distribute, transmit, share, or sell the digital file or printed copies of the pattern itself to any third party. You may not alter the pattern and claim it as your own design. You may not use the pattern for mass production or commercial manufacturing.
   

3. Digital Downloads and Delivery

Upon successful completion of payment, your digital quilt patterns will be made available for download. This may occur via an instant download link on the checkout page, an email sent to the address you provided during checkout, or through your customer account portal on the Site. Please ensure your email address is entered correctly. We are not responsible for delivery failures due to incorrect email addresses or restrictive spam filters.

4. Purchases and Payment

We accept the following forms of payment: Visa, Mastercard, PayPal, Apple Pay. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us in accordance with local and international tax laws.

5. Refund and Return Policy

Due to the digital nature of our products, all sales of digital quilt patterns are final. We do not offer refunds, returns, or exchanges once the digital file has been downloaded or emailed. If you experience technical difficulties downloading or opening your file, or if you accidentally purchased a duplicate pattern, please contact us at nika@patchworkwilds.com within 14 days of purchase, and we will work with you to resolve the issue.

6. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

7. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

 

Prohibited activities include, but are not limited to:

• Systematically retrieving data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

• Tricking, defrauding, or misleading us and other users, especially in any attempt to learn sensitive account information such as user passwords.

• Circumventing, disabling, or otherwise interfering with security-related features of the Site.

• Using the Site or our digital products in a manner inconsistent with any applicable laws or regulations.
   

8. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site and our products at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or our digital products.

9. Disclaimer and Limitations of Liability

The Site and our digital products are provided on an as-is and as-available basis. You agree that your use of the Site and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to the Site. We assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of pattern dimensions, fabric requirements, or instructions, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site or our patterns.

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or our digital products, even if we have been advised of the possibility of such damages.
